Public offer agreement (for International Orders)
This Public Offer Agreement (hereinafter referred to as the “Agreement”) is concluded between the Online Store located at https://dressinupartatelier.com (hereinafter referred to as the “Seller”) and any person who uses the Online Store’s services (hereinafter referred to as the “Buyer”).
This Agreement determines the terms and conditions for the purchase and sale of goods through the Online Store.
By placing an order on the website, the Buyer confirms that they have read, understood, and accepted this Agreement.
1. General Provisions
1.1. This Agreement is an official and public offer addressed to all potential Buyers.
1.2. By placing an order, the Buyer fully accepts the terms related to ordering, payment, delivery, exchange, and return, as well as other conditions set out in this Agreement.
1.3. The Agreement is considered concluded from the moment the Buyer confirms the purchase by clicking the corresponding action button (such as “Place Order,” “Buy Now,” “Checkout,” or another similar confirmation button) on the website.
1.4. The Seller reserves the right to amend the terms of this Agreement without prior notice. The current version is always available on the website.
2. Terms and Definitions
2.1. Online Store – the Seller’s website located at https://dressinupartatelier.com, created to enable remote purchase and sale of goods through the Internet.
For convenience, the Online Store and the brand may also be referred to on the website as “DUAA”, which is the short form of DressinUpArtAtelier.
2.2. Goods (Products) – items offered for sale by the Seller on the Online Store, including their description, images, sizes, and prices. Information about the Goods may be updated, changed, or supplemented by the Seller at any time without prior notice to the Buyer.
2.3. Buyer – an adult individual who has reached the age of 18, or a duly authorized representative of a company, who receives information from the Online Store, places an order, and purchases Goods for personal or professional use outside the territory of Ukraine.
2.4. Order – a properly completed request of the Buyer, submitted through the Online Store, for the purchase and delivery of selected Goods.
2.5. Website – a set of web pages combined by a single content management system, available on the Internet at https://dressinupartatelier.com, used to display product information, accept orders, and provide related services.
3. Subject of the Agreement
3.1. The Seller undertakes to deliver the Goods ordered and paid for by the Buyer, and the Buyer undertakes to pay for and accept the Goods in accordance with this Agreement.
3.2. The Online Store sells and delivers Goods using international postal and courier services listed on the website.
3.3. Product photos on the website are for illustrative purposes only; the actual appearance or color may vary slightly due to lighting or screen settings.
4. Use of the Website
4.1. The Buyer may browse the website, select Goods, and place orders without registration.
4.2. The Buyer is responsible for providing accurate, complete, and up-to-date information required for order processing and delivery.
4.3. The Seller is not liable for any consequences resulting from the Buyer’s submission of inaccurate or incomplete data.
5. Ordering Procedure
5.1. The Buyer places an Order independently by selecting Goods, adding them to the shopping cart, and confirming the order by clicking the appropriate confirmation button (such as “Place Order,” “Buy Now,” “Checkout,” or any similar action button) on the website.
5.2. Orders placed through the Ukrainian website https://dressinupartatelier.com.ua are valid only for domestic sales within Ukraine and are not covered by this Agreement.
5.3. By confirming the Order, the Buyer gives consent to the processing of personal data for order fulfillment and agrees to this Agreement and the Privacy Policy.
5.4. If an ordered item is unavailable, the Seller may cancel the corresponding part of the Order or offer a replacement. The Buyer will be notified by email or phone. Any payments for unavailable items will be refunded or replaced at the Buyer’s discretion.
6. Price and Payment
6.1. Prices for Goods are displayed in euros (EUR) or US dollars (USD).
6.2. The total cost of the Order, including delivery fees, is displayed before the Buyer confirms the Order.
6.3. Payment is made through secure payment systems listed on the Online Store’s website.
6.4. Any currency conversion or international transaction fees are the Buyer’s responsibility.
6.5. Payment is considered completed once the Seller receives the corresponding funds.
7. Delivery and Customs
7.1. The Seller arranges international shipping through postal or courier services listed on the website.
7.2. Delivery times depend on the destination country and chosen delivery method.
7.3. Customs duties, import taxes, and any other fees imposed by the destination country are the Buyer’s responsibility.
7.4. The Seller is not responsible for delays, losses, or damages caused by shipping companies or customs services after dispatch.
8. Exchange and Return Policy
8.1. The Buyer has the right to request an exchange or refund within 14 calendar days from the date of receiving the order.
8.2. Returned Goods must be unused, unworn, and in their original condition and packaging.
8.3. Custom-made or personalized products cannot be returned or exchanged, except in cases of confirmed manufacturing defects or mistakes made by the Seller.
8.4. To initiate a return or exchange, the Buyer must contact the Seller via email within 14 days, indicating the order number and reason for the return (with photos if applicable).
8.5. The cost of return shipping is borne by the Buyer unless the return is due to the Seller’s error.
8.6. Refunds are issued after the Seller receives and inspects the returned Goods and are processed through the same payment method used for the purchase.
9. Confidentiality and Personal Data
9.1. By placing an Order, the Buyer consents to the collection and use of personal data for order processing, communication, and delivery.
9.2. The Seller ensures the confidentiality and protection of all personal data in accordance with the Privacy Policy.
9.3. Personal data may be shared only with trusted service providers (such as payment processors or courier companies) to fulfill the Buyer’s Order.
9.4. The Buyer may withdraw consent for data processing by contacting the Seller; however, this may limit the ability to use the Online Store’s services.
10. Intellectual Property
10.1. All content on the website—including photographs, designs, product descriptions, logos, and other materials—is the intellectual property of the Seller.
10.2. Any copying, reproduction, modification, or distribution of materials without prior written permission from the Seller is prohibited.
11. Governing Law and Dispute Resolution
11.1. This Agreement is governed by generally accepted principles of international trade and electronic commerce.
11.2. Any disputes arising between the Buyer and the Seller shall first be resolved through negotiation.
11.3. If an agreement cannot be reached, disputes may be referred to a competent court at the Seller’s place of registration.
12. Final Provisions
12.1. The Seller may amend this Agreement at any time without prior notice.
12.2. The current version of the Agreement is always available on the website and applies to all new orders.
12.3. If any clause of this Agreement is found invalid, the remaining clauses remain in full force and effect.
